Case Commentary

Does a Judge need to have (and this is a technical term, so bear with me) a Heartbeat in order to render decisions?

In a landslide decision (full majority), The Supreme Court has decided that a Judge must (indeed) be alive in order to render Judgement.

The case is slightly more technical than that... but only slightly. In short, despite a Judge's intent (or a Court's belief of a Judge's intent), if the Judge in question should die before the Verdict is finalized, any Judgement (participation, or vote) of the Judge in question is Void.

It's pretty Open and Shut.

Please keep in mind, this is only a Supreme Court case because a Lower Court came to the opposite conclusion.
